1. Preliminary remark

The Artition.com internet platform aims to enable artists and creative people to present their works to an international public online free of charge as registered users. Works from virtually all areas are welcome. In particular, Artition.com supports contributions from music, literature, painting, photography and modelling which in their turn are subcategorised. The users themselves determine the status Artition.com will achieve and can make it into a huge meeting place, the largest platform for artists ever, by inviting all artists they know to participate in Artition.com. Artition.com is composed of two sections: a private and a public section. The public section is for any creative person wishing to present his or her works freely and completely free of charge. The private section is occupied by renowned, established artists from all areas who have the possibility to invite young artists from the public section to the private section, thereby substantially improving their carrier opportunities true to the old adage that connections are everything. Artition.com does not charge participation fees but is exclusively financed by advertising.


2. User registration to the public / private section of artition.com and activation

a. User registration to the public section

Before a user can log into the public section, the user must register via the start page of Artition.com. A user name with at least 2 characters and a password with at least 4 characters must be entered. A valid e-mail account of this user is also required. Further personal data can but need not be provided. Finally, the user must confirm that he recognises the Terms of Service and the privacy policy of Artition.com. As soon as the data is completely available to Artition.com, a user account (“Account”) is set up and the user activated so that it is possible to log in to Artition.com via the start page using the user name and password. Following successful registration the works may be presented by the user online.

b. User registration to the private section

It is possible to register for the private section of Artition.com only via a link in an invitation mail of a private user. The user is brought to the sign-up area of the private section via this link. The registration from this point is the same as the registration for the public section.


3. User deregistration of Artition.com

If the user wishes his participation in Artition.com and his user data to be deleted, it is sufficient to send Artition.com an e-mail with this request. The account will then be immediately deleted including all data provided online for the account. Artition.com furthermore ensures that the entire user-related data will be deleted from the server one month after deregistration at the latest. Compulsory deregistration shall be made in accordance with the provisions of Paragraph 5 and 6 of these Terms of Service. After notifying the user about the deregistration by e-mail, the data provided by the user online shall be immediately deleted. Artition.com furthermore ensures that the entire user-related data will be deleted from the server one month at the latest after deregistration.


4. Right of use

Artition.com is entitled to use, copy, disseminate and exhibit the works presented and in particular to make them publicly accessible via the Artition.com internet platform.


5. Undesirable works

Artition.com hereby forbids registered users from presenting in particular pornographic, immoral and racist content as well as copyrighted and criminal content. The registered user is agreed that Artition.com may decide at its discretion whether the acceptance of any of the above mentioned content is justified. Artition.com also reserves the right to remove any content and to deregister the user immediately. Renewed registration and activation is then only possible following the explicit written consent of Artition.com sent by post.


6. Property, copyright and liability

The works presented by the registered user on the Artition.com internet platform shall remain the property of the registered user. The registered user guarantees that he exclusively has the copyright to the works presented by him on Artition.com or that he has permission of the copyright holder to use the works accordingly. Artition.com shall assume no liability for the works presented by the registered users. The registered users are solely responsible for the content of their works presented on the internet platform; this shall apply in particular with respect to copyright and criminal provisions and to any provisions that may substantiate damage claims


7. Venue

Venue for all disputes concerning the use relationship with Artition.com is Oberrohrdorf, Switzerland.
