1. Preliminary remark
KCS (“Artition”) would like to inform you in the following how Artition uses your personal data and how data protection is guaranteed when you use the services on the internet platform www.artition.com.
2. Responsible body
The responsible body within the meaning of data protection law is KCS (see Legal Information). If you have any questions on the use of your data, please send an e-mail to Artition.
3. Consent
The applicable statutory provisions, in particular in Germany the Federal Data Protection Act (Bundesdatenschutzgesetz) and the Telemedia Act (Telemediengesetz) are pertinent to the use of your data. If Artition would like to use your data for purposes that require your consent under these provisions, Artition shall obtain your explicit consent prior thereto. You may revoke any consent you may have made at any time to take effect for the future. The mere registration and/or use of Artition services do not replace your explicit declaration of consent.
4. Use of your data
a. Collection of data
Artition collects data as soon as you have set up an Artition user account (“Account”) or if you visit or use services. If you set up an account by registration, Artition will ask you to provide specific information on yourself. Of this information the mandatory details are those required by Artition for the contractual relationship or to provide the services. If you use or visit Artition services, Artition will collect and save technical information that your internet browser sends to Artition. This information concerns in particular the IP address of your computer, the name of presented works and the page(s) you visit
b. Processing and use of data
Artition uses the data for your personal account (master data) to substantiate and manage the contractual relationship. Artition may also anonymously analyse use profiles for advertising, market research, statistics and to improve the Artition services insofar as you have not made use of your statutory right to oppose this use of your data.
c. Transmission of data to third parties
Non-anonymised, personal data shall only be disclosed to third parties, such as private users wishing to invite users registered in the public area to the private area, if you have given you explicit consent. Under pertinent law government bodies may also request information or data from Artition in satisfaction of statutory requirements, e.g. for the purpose of criminal prosecution.
d. Deletion of data
Your data shall be deleted if they are no longer required for the intended purpose or for the continuation of the agreement. Please remember that for every deletion the data is initially only barred and then finally deleted with a time delay in order to take into consideration any accidental deletions or any wilful damage. For technical reasons, data are duplicated in backup files and disk mirroring of Artition. Any such copies are first deleted with a technically-related temporal delay and at the latest after one month.
e. Editing and/or deleting personal data of your account
You are entitled to view any saved personal data and settings of your account at any time and to correct, supplement or delete these. If you wish Artition to delete your user account completely, please send an e-mail to Artition.
5. Data security
Artition takes special technical precautions to protect your data from unauthorised access or loss. Your personal data are only accessible to those employees who must have access to your data in order to go about their work and to be able to offer you Artition services as best possible.
6. Amendment to the data protection provisions
Artition reserves the right to amend the data protection provisions in accordance with the applicable legal situation and actual requirements. The amendments shall be marked specially and with the date of the amendment.
